Which Way I Ought to Go.

I was recently reminded of the conversation Alice had with the Cheshire Cat in “Alice in Wonderland,” of a person deciding to litigate their divorce, without understanding the consequences.

[Alice] went on. “Would you tell me, please, which way I ought to go from here?”

“That depends a good deal on where you want to get to” said the Cat (lawyer)

“I don’t much care where,” said Alice

“Then it doesn’t matter which way you go,” said the Cat (lawyer), meaning if you litigate, it will be up to the judge.  You will have no say on the outcome, and hence your future.

 

I don’t think many clients are happy with a judge’s decision.  His/her ruling is impartial, there is little if any deviation from the law, so it doesn’t matter who is at fault, what the other person did, or what is in the best interests financially to minimize taxes and maximize financial outcomes for both parties.

Litigation is like the George Harrison song “Any Road”

“We pay the price

With the spin of the wheel, with the roll of the dice

Ah, yeah, you pay your fare

And if you don’t know where you’re going

Any road will take you there…”
